8. APPLICABLE LAW

8.1. By visiting rootsense.in, you agree that the laws of India, under the jurisdiction of the Courts at New Delhi, without regard to principles of conflict of laws, will govern this Privacy Policy and any dispute of any sort that might arise between rootsense.in (or its affiliates) and you.

9. DISPUTES RESOLUTION

9.1. You agree that all disputes arising out of or in connection with Rootsense or rootsense.in shall in the first instance be referred to the designated representatives mutually appointed by the parties (Rootsense and you) to settle by way of amicable discussions or negotiations. In the event the parties are unable to arrive at a settlement within a period of thirty (30) calendar days from the date of reference of the dispute to the designated representatives, such dispute shall be settled by a sole arbitrator selected by mutual consent of the Parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 or any amendment thereof for the time being in force. The award of the arbitrator shall be a reasoned award and shall be final and binding on the parties. The venue and seat of arbitration will be at New Delhi. The arbitration proceedings shall be conducted and the award shall be rendered in English language. Each party shall bear its own costs relating to such arbitration, and the parties shall equally share the arbitrator’s fees. Nothing shall preclude Rootsense from seeking interim or permanent equitable or injunctive relief, or both, from any court having jurisdiction to grant the same.
