Shipping Policy
1. All of Rootsense (hereinafter ‘we’ or ‘us’ or ‘our’) orders are shipped door- to-door from our warehouse at Ghaziabad, Uttar Pradesh, India, to your provided shipping address via our delivery partners. Processing the order normally takes 1 working day(s) and then shipping normally takes 7-10 business days. Please note that Monday to Friday are considered business days, excluding public holidays.
2. Shipping destinations offered by rootsense.in for delivery may be extended and accordingly updated on the website from time to time.
3. We aim to keep stock of every item displayed for sale on our website. If, in the event the item purchased by you as displayed on the website is not available, we shall promptly inform you within 1 working day(s) of your purchase and fully refund your money for the item that is out of stock.
4. We can only process one shipping address per order. If you wish to order more than one item and wish to ship them across different addresses, then in that case it is requested to treat these as separate orders.
5. Delivery of an order shall be completed when we deliver the products to the address provided by you, or when you collect such products from us.
6. Our delivery partner (Shiprocket) will attempt delivery 2 times at the delivery address specified by you in the order, before they contact us about your package not being deliverable. You may track the package through the order tracking facility. If the package status is shown as undeliverable, you may contact the Shiprocket (delivery partner) Customer Service at their local number and quote your tracking number to trace your package.
7. Products are shipped to you based on the information which you provide to us and you are responsible for the accuracy of such information. If any regulations are breached (including but not exclusively export/import regulations) due to inaccurate information provided by you then you are responsible for such breach.
8. At the moment, we only accept ‘cash on delivery’ as the mode of payment. In the event, you refuse to accept the order or make full payment at the time of delivery, we reserve our right to refuse to deliver the product(s).
9. While we strive for timely deliveries, there might be occasional delays, especially around public holidays or due to unexpected situations. Rest assured, we make every effort to provide efficient service to all our customers.
10. DUTIES AND TAXES
10.1. All of Rootsense orders are shipped nationally/internationally from our warehouse in Ghaziabad, Uttar Pradesh, India, to your provided shipping address via Shiprocket (delivery partner). For international orders, the customers shall bear the shipping charges or any other costs of shipping the order to the desired destination. Due to the nature of international shipping, occasionally a customer may also have to pay additional import duties and taxes which are levied once a shipment reaches your country. However, the levying of customs charges may vary from time to time and depend on the place of delivery. In the cases where additional customs charges are assessed, you shall be liable to pay these additional fees. If you are presented with an invoice from the Shiprocket (delivery partner) for import duties and taxes, you will be obligated to pay Shiprocket (delivery partner) directly at the time of delivery. Rootsense takes no responsibility for nondelivery of orders in case such taxes and duties are not accepted and settled by the recipient at the delivery address and will not provide any refunds in such cases.
11. APPLICABLE LAW
11.1. By visiting rootsense.in, you agree that the laws of India, under the jurisdiction of the Courts at New Delhi, without regard to principles of conflict of laws, will govern this Shipping Policy and any dispute of any sort that might arise between rootsense.in (or its affiliates) and you.
12. DISPUTES RESOLUTION
12.1. You agree that all disputes arising out of or in connection with Rootsense or rootsense.in shall in the first instance be referred to the designated representatives mutually appointed by the parties (Rootsense and you) to settle by way of amicable discussions or negotiations. In the event the parties are unable to arrive at a settlement within a period of thirty (30) calendar days from the date of reference of the dispute to the designated representatives, such dispute shall be settled by a sole arbitrator selected by mutual consent of the Parties. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 or any amendment thereof for the time being in force. The award of the arbitrator shall be a reasoned award and shall be final and binding on the parties. The venue and seat of arbitration will be at New Delhi. The arbitration proceedings shall be conducted and the award shall be rendered in English language. Each party shall bear its own costs relating to such arbitration, and the parties shall equally share the arbitrator’s fees. Nothing shall preclude Rootsense from seeking interim or permanent equitable or injunctive relief, or both, from any court having jurisdiction to grant the same.
